The website www.maisonamorine.com (the “Site”) is an informational and e-commerce website accessible via the Internet, open to all users of this network. It is published by the company Maison Amorine (“Maison Amorine”), a simplified joint-stock company (SASU) with a capital of 10,000 Euros, whose registered office is located at 30 allées de Tourny - 33000 Bordeaux, registered with the Bordeaux Trade and Companies Register under number 838873008, and whose intra-community VAT number is: FR FR14838873008.

Maison Amorine offers for sale to internet users browsing the Site (the “User”) a number of products, cosmetic ingredients, cosmetics, and accessories manufactured by and/or for Maison Amorine (the “Products”). A User who has confirmed an order shall be referred to as a “Customer”.

Any order for a Product offered on the Site implies prior review and express, unreserved acceptance of these General Terms and Conditions of Sale (the “GTC”), as indicated by checking the box “I declare that I have read and accept Maison Amorine’s General Terms and Conditions of Sale without reservation and am aware of my right of withdrawal.”

ARTICLE 1 PURPOSE AND SCOPE OF APPLICATION

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of distance selling between Maison Amorine, on the one hand, and any person making a purchase on the Site (hereinafter the “Customer”), on the other hand.

These General Terms and Conditions of Sale, written in French, specify in particular the various steps required for the Customer to place an order, the terms of payment and delivery, as well as the tracking of the Customer’s order.

These Terms apply to the exclusion of any other document, including any terms and conditions of purchase of the Customer.

The Terms of Sale define the rights and obligations of the Parties in connection with the sale of Products by Maison Amorine to Customers. Maison Amorine reserves the right to modify the Terms of Sale at any time, provided that the applicable Terms of Sale shall be those in effect on the date of the order. The fact that Maison Amorine does not invoke a provision of the T&C or a right shall not be construed as a waiver of the right to invoke it at a later date.


ARTICLE 2 PREREQUISITES FOR ACCESS TO AND OPERATION OF THE SITE

2.1 Operation of the Site

Maison Amorine cannot guarantee constant availability or uninterrupted access to the Site.

Maison Amorine nevertheless strives to ensure a high-quality user experience when browsing the Site’s pages. Maison Amorine reserves the right to suspend, without prior notice, access to the Site and its Products for maintenance purposes or to update the information provided.

The content, presentation, and operation of the Site are subject to changes, deletions, or updates at Maison Amorine’s discretion, at any time and without notice, in accordance with Maison Amorine’s commercial policy and the Site’s operational requirements, provided that such changes, deletions, or updates will not affect orders already placed.

Consequently, the Customer may only order Products available on the Site on the day of their visit.

2.2 Access to the Site

Orders are placed on the Site, which is accessible via the Internet 24 hours a day, 7 days a week, except in cases of force majeure, events beyond Maison Amorine’s control, or during maintenance, updates, technical improvements, or content modifications.


ARTICLE 3 PRODUCTS

3.1 Products

The Products offered for sale by Maison AMorine are those listed on the Site on the day the User visits the Site and are subject to availability.

Products are presented via an information sheet (photograph, product description, composition, and price) prepared with the utmost accuracy and precision to provide the most faithful and complete description possible.

Maison Amorine shall not be held liable for minor variations from the actual products.

The Customer is required to refer to the description of each Product to learn about its essential properties and characteristics.

Maison Amorine shall not be held liable to the Customer or any third party for any harmful consequences resulting from the removal of a Product from the Site, or from the replacement or modification of any content or information appearing on this Site.

In the event that a Product is unavailable, the User or Customer will be notified:

  • either while browsing the Site,

  • or following order confirmation and prior to delivery, via email.

Since payment is charged at the time the Product is ordered, in the event of unavailability after the order is placed, Maison Amorine will issue a refund to the Customer.

3.2 Selection, Use, and Storage of Products

The Customer makes their selection and purchases the Product under their full and sole responsibility.

Maison Amorine shall not be held liable for any damage caused by misuse or improper storage of a Product, or by failure to follow usage precautions and health and safety guidelines when using a Product.

For any questions or requests for additional advice, the Customer may contact Maison Amorine’s customer service using the contact form available in the “Contact Us” tab or visit one of the physical retail locations.

3.3 Resale of Maison Amorine Products

The resale of Maison Amorine products is authorized only if provided for in a specific written contract signed between the Customer/reseller and Maison Amorine. In the absence of such a contract, any resale and/or commercial use of one or more Products—even if incorporated or mixed into a more complex preparation—is strictly prohibited.

Similarly, any repackaging of a Product for resale under another brand is strictly prohibited, unless expressly agreed to in writing and in advance by Maison Amorine.


ARTICLE 4 USER REVIEWS AND COMMENTS

For any purchase of a Product, the Customer will have the opportunity to provide feedback on it. The Customer may also view the reviews and recommendations of other users. The reviews and recommendations expressed for each Product reflect only the views of those who posted them. These reviews and recommendations shall in no way constitute a contractual obligation on the part of Maison Amorine nor give rise to any liability on its part. Maison Amorine monitors the reviews and reserves the right to remove any disrespectful, inappropriate, or offensive review or comment.

The star symbols appearing on the Site next to the Products represent the average rating, at a given moment , left by people who have commented on our Site regarding that Product. They are therefore subject to change on a daily basis.

The total number of reviews displayed on the Site includes customer reviews from all countries. Any User may view them by changing the country via the flag in the site menu.


ARTICLE 5 PRICES

5.1 Prices

Without prejudice to orders placed by the Customer, Maison Amorine reserves the right to modify its prices at any time. However, it undertakes to apply the current rates indicated at the time of the order, subject to availability on that date.

Prices are applicable in the context of distance selling.

The prices listed on the Site are guaranteed as of the date of the order, subject to stock availability and except for obvious typographical errors or omissions.

Product prices are listed in euros and are valid for territories within the European Union, excluding French overseas departments and territories.

They include any applicable discounts as well as the VAT rate in effect on the date of the order.

For orders delivered outside the European Union as well as to the French Overseas Departments and Territories:

Any Order placed on the Site and delivered outside the European Union, the French Overseas Departments and Territories (DOM and TOM), and other areas not subject to VAT, will be invoiced without VAT and may be subject to any applicable taxes, customs duties, and other related fees imposed when the package reaches its destination. These additional costs are the responsibility of the Customer and are their sole liability. It is the Customer’s responsibility to check with local authorities.

The Products sold by Maison Amorine comply with French regulations. It is therefore the Customer’s responsibility to check with the local authorities in their country regarding any import or usage restrictions on the ordered Products.

Maison Amorine cannot be held liable for the purchase of a Product deemed non-compliant in a given country, even though said Product complies with French regulations.

Shipping Costs:

The prices listed do not include shipping costs, which will be billed separately or waived depending on the order amount and the country of delivery, and will be specified to the User upon final confirmation of their order.

These shipping costs do not include customs duties and other related fees that may be charged upon entry into certain countries; these costs remain the sole responsibility of the Customer.

The Products remain the property of Maison Amorine until delivery to the Customer.

5.2 Promotional Offers

Promotional offers are valid for the duration indicated, while supplies last. Orders can only be accepted if the prices listed match those of the current offer.

The User may also have received a promotional offer via email. In this case, they must enter and validate their “promo code” in the space provided for this purpose on the order summary page.

5.3. Gifts

The Customer may send gifts to loved ones via the Site. The ordering process remains the same as that followed for personal purchases. The Maison Amorine Site allows the Customer to send a personalized message to the gift recipient. This message will appear on the document accompanying the merchandise upon delivery.

The gift recipient will also benefit from all the guarantees stipulated in Article 13 below.


ARTICLE 6 CREATING AN ACCOUNT

Creating a User/Customer account (the “Account") is not required to place an order.

If the User/Customer chooses to create an account:

The User’s registration on the Site is validated by Maison Amorine after verification of the standard form completed by the User. The User receives a registration confirmation email.

When creating their Account, the User must ensure the accuracy and completeness of the information they provide. The User is required to keep their personal information up to date at all times. In the event of an error in the recipient’s contact information, Maison Amorine shall not be held liable for the inability to deliver the Products.

Registration on the Site is reserved for natural persons who are of legal age and have full legal capacity to enter into contracts.

ARTICLE 7 ORDER PLACEMENT AND CONFIRMATION

The User may view the various Products offered for sale by Maison Amorine on its Site.

The User may browse the various pages of the Site freely without being bound by an order.

Any order constitutes acceptance of the prices and descriptions of the Products available for sale.

Maison Amorine undertakes to fulfill orders received on the Site only to the extent that the Products are in stock.

Maison Amorine shall not be held liable for any data entry errors made by Customers or Users or for any resulting consequences.

Maison Amorine reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment for a previous order or for any other legitimate reason within the meaning of Article L.121 -11 of the French Consumer Code.

Maison Amorine reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment for a previous order or who presents any form of risk.

Any order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

Placing an order by the Customer implies their full and unreserved acceptance of these General Terms and Conditions of Sale, to the exclusion of all other general terms and conditions of sale or purchase.

7.1 Placing an Order

The confirmation of the Product Order placed by the Customer on the Website is subject to compliance with the process described below:

To place an Order, the Customer must follow all instructions on the Website.

  1. The Customer may create an Account to place an Order.
  2. If the Customer chooses this option, once the Account is created, the Customer will provide their username and associated password.
  3. In all cases, the Customer agrees to provide true and accurate information and to notify Maison Amorine of any changes regarding them; it is hereby noted that the Customer’s password will be personal and confidential. It is also specified that the User is informed and agrees that the use of these two identifiers constitutes proof of their identity and expresses their consent.
  4. Review the essential characteristics of the Product as presented on the Site and select the Product;
  5. Add the selected Product(s) to the shopping cart; access to the shopping cart is available at any time for modification or confirmation;
  6. Confirm the shopping cart after verifying its contents;
  7. Access the account to confirm and complete the contact information required for delivery; if the Customer does not already have an account on the Site, create a customer account and fill in the required information regarding their identity;
  8. Verify the information appearing in the Order summary, and unreservedly accept the Site’s current General Terms and Conditions of Sale;
  9. Confirm the Order;
  10. Enter and confirm the information regarding the online payment method.

The Customer’s final acceptance is confirmed by the validation of their payment, regardless of the payment method chosen from those available on the day of the order.

  • Promotions / Discounts

To take advantage of a promotion sent to them, the User must enter and validate their “promotional code” in the designated field on the page displaying their “Cart.”

  • Gift Card

To use a gift card, the User must enter and confirm their gift card code in the designated field on the page displaying their “Cart.”

7.2 Order Confirmation

Within one hour of placing their order, the Customer will receive a confirmation email that includes:

  • Confirmation that their order has been registered,
  • A summary of the items ordered,
  • The total amount of the order,
  • Any associated shipping costs, if applicable,
  • The estimated delivery date or timeframe,
  • The selected payment method,
  • Information regarding the right of withdrawal,
  • A summary of their personal data, including the delivery address,
  • Confirmation that their card will be charged immediately after the order is placed.

When the User confirms their payment, the order is registered and the User becomes a Customer.

Thus, the sale is considered final only after Maison Amorine sends the order acceptance confirmation to the Customer via email and after Maison Amorine receives full payment.

The Customer agrees that the order confirmation shall be considered proof of the contractual relationship between the Parties.

ARTICLE 8 PAYMENT TERMS

The payment options available when placing an order are credit card (Visa, Mastercard, CB, JCB, etc.) and PayPal, and appear automatically during the payment step.

Certain credit cards or specific payment methods may not be accepted depending on the billing country or the issuing bank. These restrictions will be clearly indicated during the ordering process.

Maison Amorine reserves the right to remove or add payment methods without prior notice. Additionally, payment applications operate according to their own Terms of Use.

It is important to note that transactions can only be made in euros for countries outside the European Union.

Maison Amorine reserves the right to cancel an order for just cause, particularly if the order is flagged by the fraud detection module as posing a risk of fraudulent credit card use.

Payment Security: When selecting a credit card to make a payment, the Customer is automatically redirected to the secure payment platform’s payment server.

This platform is secured by SSL (Secure Socket Layer) encryption to protect all data related to payment methods.

Thus, this banking information is known only to the payment service provider selected by Maison Amorine. It is neither transmitted nor stored on Maison Amorine’s computer systems, nor is it handled or accessible by its staff.

ARTICLE 9 ORDER TRACKING AND MODIFICATION

Upon receipt of the order summary, the Customer will have access to “order tracking” by clicking on “My Account” and logging in with their email address and password.

It is the Customer’s responsibility to verify the accuracy of the order and to report any errors immediately.

9.1 Modification

Any changes to the contents of an order (products, quantities, etc.), the associated contact information (shipping address, billing address, etc.), or the application of a promotion or discount must be made before payment is processed. Once payment has been made, the order can no longer be modified, including by Customer Service

9.2 Order Suspension

Maison Amorine reserves the right to suspend the processing of an order and any delivery in the event of a refusal of payment authorization by officially accredited organizations or in the event of non-payment.

Maison Amorine also reserves the right to refuse to make a delivery or fulfill an order from a Customer who has not paid for their order in full or with whom a payment dispute is currently pending.

9.3 Order Archiving

The Customer’s shopping cart is archived and retained for a subsequent order for a period of 3 months, even in the event of an interruption in the Internet connection. However, to access their archived shopping cart, the Customer must reconnect to the Site using the same computer with the same IP address used to connect to the service.

Order details for amounts equal to or exceeding €120 are archived in accordance with Article L.213-1 of the French Consumer Code for a period of ten (10) years on a secure server.

ARTICLE 10 DELIVERY

Delivery consists of the transfer to the Customer of physical possession or control of the Product.

10.1 Product Delivery Fees

For each order, a flat-rate shipping fee is charged.

The flat-rate fee is based on the delivery method selected by the Customer at the time of placing the order and is billed by country.

As stated in Article 5 herein, shipping fees do not include customs duties and other related fees that may be charged upon entry into certain countries; these fees remain the sole responsibility of the Customer.

10.2 Delivery Times and Methods

The estimated delivery date provided at the time of order completion is for informational purposes only and does not constitute a guaranteed date.

These delivery times are subject to postal delivery issues and force majeure.

Maison Amorine cannot be held liable for delivery delays caused by force majeure (as defined in Article 17 below) or by the Customer providing an incorrect or incomplete address.

It takes into account the preparation time and delivery time described below:

10.2.1 In mainland France

Preparation time

Orders are shipped within 24 to 48 hours (excluding holiday periods and exceptional order peaks, such as during product launches).

Delivery Times

Depending on the selected shipping method, we hand over the order to the carrier for shipment (La Poste, Chronopost, Colissimo, etc.). The delivery time depends on the carrier and the selected shipping method.

10.2.2 Delivery Outside Metropolitan France

Shipping times and methods vary depending on the destination country and will be specified at the time of ordering.

10.3 Delivery Address

The Products ordered will be sent to the address provided by the Customer during the ordering process. The delivery address cannot be changed after the Customer has confirmed the order. It is therefore the Customer’s responsibility to verify all information before confirming payment. The transfer of risk occurs upon delivery of the Products to the delivery address provided by the Customer or, where applicable, upon pickup of the package from the carrier

10.4 Transfer of Ownership and Risk

The transfer of ownership of the Products and risk takes effect upon delivery. From that point on, the Customer is required to ensure that they are kept in a safe place and in good condition. However, ownership of the Products may under no circumstances be transferred to the Customer who has not fully and effectively paid the price.

11. ORDER RECEIPT

11.1 Delay / Loss of Package During Shipping

Maison Amorine selects reliable partners to ensure the transport and delivery of packages. However, delays or loss of packages are possible, albeit rare. As with any shipment, there may be a delay in delivery or the package may go missing. In the event of a delivery delay of more than 7 days, the Customer must notify Maison Amorine’s customer service, which will forward the information to the carrier to initiate an investigation. This investigation may take up to 21 days from the date it is opened. If the package is found during this period, it will be immediately re-routed to the Customer’s address (in most cases). If, however, the package is not found by the end of the 21-day investigation period, the package will be considered lost. In this case, Maison Amorine will send the Customer a replacement package at its own expense. If the lost product(s) are no longer available at that time, Maison Amorine will refund the Customer the total amount of the order placed, including shipping costs.

11.2 Returns Cited as “Unclaimed”

Returns of packages that have not been claimed by the Customer by the end of the holding period specified for the chosen delivery method (post office, retailer, Click&Collect, etc. ) will not be refunded to the Customer, unless the packages and products are returned to Maison Amorine within a reasonable timeframe and in perfect condition.

11.3 Returns due to “Undeliverable Address”

Returns of packages that could not be delivered due to an incomplete or incorrect address, a mailbox, or a recipient that prevents delivery (inaccessible, unidentifiable, unavailable, etc.) will not be refunded to the Customer, unless the packages and Products are returned to Maison Amorine within a reasonable timeframe and in perfect condition.

11.4 Returns due to refusal of customs clearance

Returns of packages that could not be delivered due to the Customer’s refusal to clear customs or unauthorized import at the destination will not be refunded to the Customer, unless the packages and Products are returned to Maison Amorine within a reasonable timeframe and in perfect condition.

11.5 Order Cancellation

In the event of a delivery delay of more than 28 days from the scheduled delivery date, the Customer may cancel their order by contacting Maison Amorine Customer Service via email at the address listed on the website under the “Contact Us” tab. In this case, at the Customer’s discretion: Maison Amorine will send the Customer a replacement package at its own expense, or Maison Amorine will refund the Customer the total amount of the order placed, including shipping costs.

11.6 Issues

Each delivery is deemed complete upon the Carrier’s delivery of the Product(s) to the Customer or to a third party designated by the Customer. It is the Customer’s responsibility to immediately verify, upon receipt of the Product(s), the conformity and integrity of the shipped Product(s).

Any discrepancy must be reported to Customer Service within twenty-four (24) hours of the order’s delivery and before any use of the Products. Customer Service shall be entitled to request any information necessary to facilitate a prompt resolution.

ARTICLE 12 - RIGHT OF WITHDRAWAL – RETURNS – REFUNDS

12.1 Time Limit and Procedures for Exercising the Right of Withdrawal

Pursuant to Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011, on consumer rights, and Law No. 2014-344 of March 17, 2014, as transposed into Articles L. 221-18 et seq. of the French Consumer Code, any consumer has the right to cancel their order at any time within 14 calendar days following the date on which they received the Product(s), without having to provide a reason or pay any penalties, provided that the Products are returned in their original packaging, complete (i.e., accessories, instructions), in perfect condition, and unopened.

This withdrawal period expires 14 days after the day on which the Customer or a third party other than the carrier and designated by the Customer takes physical possession of the Product.

In the event of failure to comply with the aforementioned deadlines, Maison Amorine will not be able to proceed with the refund of the Product(s) in question. The sale will be considered final and binding.

In accordance with Article L.221-18 of the French Consumer Code, only products that are unsealed, unopened, unused, complete, and undamaged are eligible for the right of withdrawal.

12.2 Returning Products

To exercise the right of withdrawal, the customer must:

Products must be accompanied by the withdrawal form in Appendix 1 of these Terms and Conditions or the following information on plain paper: first and last name, email address, mailing address, order number, and order date.

Return shipping costs are the Customer’s responsibility.

In the event that the Product is lost during shipping, Maison Amorine shall not be held liable.

12.3 Refund

In the event of the Customer’s withdrawal regarding part of the Products in the order, Maison Amorine will refund the amount of the returned Products, excluding shipping costs, as these are a flat rate for an order of multiple products.

If the Customer cancels the entire order, Maison Amorine will refund the total amount paid by the Customer for that order.

The refund will be issued via the same payment method the Customer used for the order or by bank transfer.

Maison Amorine may delay this refund until the Products have been received and inspected.

ARTICLE 13 LEGAL WARRANTIES: NON-CONFORMITY AND LATENT DEFECTS

13.1 General Provisions

13.1.1 Legal Warranty of Conformity

In accordance with the provisions of Articles L 211-4 et seq. of the French Consumer Code, the Customer is entitled to a legal warranty of conformity, which may be invoked within two years from the delivery of the Product. This warranty applies when the Product is unfit for the use normally expected of a similar item, does not correspond to the description provided by the Seller, or does not possess the qualities advertised by the Seller or agreed upon with the Seller. It then allows the Customer to choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L 211-9 of the Consumer Code.

13.1.2 Warranty Against Hidden Defects

Article 1641 of the Civil Code stipulates that “The seller is liable for hidden defects in the item sold that render it unfit for the use for which it is intended, or that so diminish such use that the buyer would not have purchased it, or would have paid only a lower price for it, had they known of them. ” To invoke this warranty, the Customer has a period of two years from the discovery of the hidden defect. Pursuant to Article 1644 of the Civil Code, the Customer may choose between rescission of the sale or a price reduction.

13.2 Procedure to Follow

Upon Maison Amorine’s notification of the Customer’s intention to exercise one of the aforementioned legal warranties, Maison Amorine’s Customer Service will acknowledge receipt of the Customer’s request and inform them of the procedure to follow. Upon receipt of instructions from Maison Amorine’s Customer Service and the corresponding return form, the

Customer shall return the Products presumed to be non-compliant or affected by a hidden defect to Maison Amorine at the address provided by Customer Service.

Any returned Product must be complete, unused, and accompanied by its original packaging, as well as the return form and a photocopy of the invoice.

Upon receipt of the Product(s) alleged to be non-compliant or affected by a hidden defect, Maison Amorine will inspect the Product(s) to determine whether they are compliant. Similarly, Maison Amorine may conduct a quality test on the Product(s) returned by the Customer to verify that the returned Product(s) are indeed the original Product(s). It is understood that these inspections are carried out as soon as possible and within a maximum period of one (1) month.

In the event that the non-conformity or defect of a returned Product is not confirmed by Maison Amorine, Maison Amorine will contact the Customer to agree on the next steps. If applicable, any return shipping will be at the Customer’s expense, and the shipping costs for sending the non-conforming Product to Maison Amorine will not be reimbursed.

ARTICLE 14 INTELLECTUAL PROPERTY

All elements of the Site, whether visual or audio, including the underlying technology, are the exclusive property of Maison Amorine and are protected by both copyright and trademark law.

Thus, Maison Amorine is the exclusive owner of the intellectual property rights to the following elements, without this list being exhaustive:

  • The Products offered on the Site and the trademarks associated with the Products;
  • The Site, its visual and graphic identity, its design, its functionalities, the texts, the animated or static images, the sounds, the know-how, the graphics, and any other element comprising the Site;
  • All design elements of the Site, whether graphic or technical;
  • The names, acronyms, logos, colors, graphics, or other signs that may be used;
  • Maison Amorine is also the exclusive owner of the domain name “www.maisonamorine.com.”

Consequently, the total or partial reproduction of any of these elements, whether directly or indirectly, on any medium whatsoever and for any reason whatsoever, without the prior and express consent of Maison Amorine is strictly prohibited.

The fact that Maison Amorine does not initiate legal proceedings upon becoming aware of such unauthorized uses does not constitute acceptance of said uses or a waiver of the right to pursue legal action. Any simple or hypertext link is strictly prohibited without the express written consent of Maison Amorine.

ARTICLE 15 PROTECTION OF PERSONAL DATA

The provision of personal information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders as well as for the issuance of invoices. This information is strictly confidential and is not disclosed to third parties.

The information collected is subject to computer processing for which Maison Amorine is responsible and is intended for Maison Amorine to inform the Customer about Maison Amorine’s product and service offerings.

In accordance with the amended “Data Protection Act” of January 6, 1978, the Customer has the right to access, modify, correct, and delete data concerning them. To exercise this right, the Customer may submit a request:

In case of difficulty, the Customer has the right to contact a supervisory authority

The Customer may subscribe to the Maison Amorine newsletter and thus choose to be regularly informed of the brand’s offers. The Customer may unsubscribe at any time by clicking on the link provided for this purpose in each newsletter.

The duration of data processing and retention is limited to the period during which the Customer is subscribed to the newsletter. The Customer may withdraw their consent and unsubscribe at any time by clicking the unsubscribe link at the bottom of each email.

Consequently, and in accordance with the French Data Protection Act of January 6, 1978, the Customer has the right to access, modify, correct, and delete their personal data. To do so, the Customer need only submit a request online at contact@maisonamorine.com

ARTICLE 16 LIABILITY

Maison Amorine shall not be held liable under these Terms and Conditions in cases where the damage or failure to perform its obligations is attributable to a third party, to the Customer’s fault (see in particular the terms of use set forth in Article 3.2), or to a force majeure event as defined in Article 17.

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet, particularly regarding technical performance, response times, connection times, information queries or transfers, risks of service interruptions, risks of contamination by viruses circulating on the network, and generally all risks associated with the use of the Internet. In this regard, the Customer acknowledges that it is their responsibility to install appropriate antivirus and security software on their computer equipment and any other devices to protect them against any bugs, viruses, or other harmful programming routines of this nature.

Maison Amorine shall therefore under no circumstances be held liable for any direct or indirect damage resulting from misuse or an incident related to the use of the computer, Internet access, maintenance or malfunction of servers, the telephone line, or any other technical connection, as the Customer’s connection to the Website is made under their sole responsibility.

Maison Amorine is solely obligated to deliver Products in accordance with the contractual provisions.

The Products sold on the Website comply with current regulations in France.

Maison Amorine cannot be held liable for damages of any kind, including material, immaterial, or bodily harm, that may result from the misuse of the Products or their improper storage.

All documents, descriptions, and information relating to the Products appearing on the Website are provided “as is,” without being covered by any warranty, express or implied, except for the warranties provided by law.

Given the nature of the Products, it is noted that the information provided should not be construed as medical advice or recommendations. Any intended use, particularly in a therapeutic context or for the treatment of a condition (e.g., illness, infection, etc.), must be preceded by consultation with a licensed physician or pharmacist.

The Customer is solely responsible for the purchase and selection of the Product and for its use.

The Customer agrees to comply with all applicable safety instructions and rules regarding the use and storage of the Product. The Customer also agrees to use the Product in accordance with its intended purpose, applicable regulations, and, more generally, in accordance with all usage instructions required for this type of Product.

In this regard, the Customer acknowledges having received all information and documentation pertaining to the use of the Product, having read and understood all of its terms.

As of the Product’s delivery date, the Customer shall assume all risks associated with the Product, and as such, shall be solely liable for (i) any damage or harm caused directly or indirectly by the Product or in connection with its use, to persons or property, regardless of the cause, and for (ii) any damage of any kind affecting the Product.

ARTICLE 17 FORCE MAJEURE

Neither Party shall be held liable for any delay in the performance of its obligations or for their non-performance, where such delay or non-performance is attributable to a force majeure event, as defined by Article 1218 of the Civil Code.

It is further agreed between the Parties that the following events shall be considered acts of force majeure: restrictive administrative measures, embargoes, sanctions, interventions or requirements of any kind by public authorities, circumstances resulting from a state of war, riots, civil unrest, fires, explosions, natural disasters, severe weather, shortages of raw materials, delays in the supply of raw materials, or any other cause resulting in a slowdown and/or cessation of supply to Maison Amorine by its suppliers and/or subcontractors, or the cessation of operations by a principal subcontractor of Maison Amorine.

The Party invoking an event constituting force majeure must notify the other Party within five (5) business days following the occurrence of such event. The Parties agree that they must consult with each other as soon as possible to jointly determine the terms for fulfilling the order during the duration of the force majeure event. Beyond a period of one (1) month of interruption due to force majeure, Maison Amorine shall be free to cancel the order, in which case it shall be responsible for refunding the Customer.

ARTICLE 18 MODIFICATION OF THE T&Cs

It is specified that the Customer may save or print these T&Cs, provided, however, that they are not modified.

The current Terms and Conditions may be viewed at any time under the “Terms and Conditions” section, accessible from all pages of the Website. The applicable version of the Terms and Conditions shall be the one in effect at the time the order was placed (i.e., payment for the Products in the shopping cart).

Maison Amorine may update these Terms and Conditions at any time. Such updates will be subject to prior and specific notification on the Site.

The Customer expressly agrees to the new version of the Terms and Conditions by placing a new order.

ARTICLE 19 PARTIAL INVALIDITY

If any provision of the T&Cs is rendered void or deprived of its effect, in whole or in part, by a decision or event beyond the control of the Parties, such invalidity or deprivation of effect shall not render the other provisions of the T&Cs void.

ARTICLE 20 GOVERNING LAW – SETTLEMENT OF DISPUTES

The relationship between Maison Amorine and any User/Customer is governed by French law.

In accordance with Article L612-1 of the French Consumer Code, any consumer as defined in paragraph 1 of the introductory article of the French Consumer Code may refer any dispute related to the sale of Products to a mediator free of charge, provided that the dispute could not be settled amicably and subject to the conditions of admissibility of the case. Consumer mediators are listed on the website of the Commission for the Evaluation and Control of Mediation, whose address is as follows: https://www.economie.gouv.fr/mediation/commission.

In accordance with Article R.631-3 of the Consumer Code: “The consumer may bring the matter before either one of the courts having territorial jurisdiction under the Code of Civil Procedure, or the court of the place where the consumer was residing at the time the contract was concluded or the harmful event occurred.

ARTICLE 21 LANGUAGE

In the event that the Terms and Conditions are translated into a language other than French, only this French version shall prevail in the event of any difficulties, particularly regarding interpretation, between the Parties.
